The Army on Thursday got relief in the Machhil fake encounter case,when the Jamp;K High Court issued an interim stay order in the case and sent notices to state government and other respondents. The court also called for all the records pertaining to the case from the trial courts.
Last week,the Army had sought time to file a revision petition against the Baramulla Sessions Court order,seeking to stay or quash the lower court orders which had rejected the Army plea for court martial of the accused in the fake encounter case. On Tuesday,Armys counsels Karnail Singh Wazir and D S Thakur filed a revision petition in the HC against the order of Chief Judicial Magistrate Sopore passed on July 15 and order of the Principal Session Judge Court Baramulla passed last week. Wazir said Justice Hakim Imtiyaz Hussein stayed the interim orders of the Baramulla Sessions Court and Sopore CJM court. Principal and Sessions Judge,Baramulla,last Friday had upheld the order of CJM court and directed all the accused to appear before the court. Soon after the judge upheld the CJMs order,the Army moved an application in the Sopore court seeking one months time to compile an appeal against the Sessions Courts order.
