Kasab plea not yet ready, lawyers will seek time

Case for confirmation of Kasab's death sentence is due to come up for hearing in High Court Monday.

The case for confirmation of 26/11 convict Ajmal Kasab’s death sentence is due to come up for hearing in High Court Monday but Kasab’s lawyers will seek more time for filing an appeal against the sentence. The High Court had earlier asked Kasab’s lawyers Amin Solkar and Farhana Shah to file the appeal expeditiously but they said they will seek at least 10 days more.

Shah said,“The appeal is not yet ready and won’t be filed by Monday. We will seek 10 days more.” Solkar said,“We have prepared the grounds and will file it in a few days.”

In the absence of an appeal, the court may either adjourn the matter or start hearing arguments in the confirmation of death sentence case, said special public prosecutor Ujjwal Nikam.

Solkar and Shah have been appointed to represent Kasab in the twin cases, while Nikam will represent the state in both cases as well as the appeal against the acquittal of two Indians,Fahim Ansari and Sabahuddin Ahmed.

The High Court had last month admitted the appeals against the acquittals and issued proceedings under Section 398 of the CrPC,required to facilitate their presence in court during the hearing.
