The Supreme Court has acquitted five persons for murder after holding that their victim,who died after drinking liquor laced with poison,had too steady a hand while writing his dying declaration accusing them of his death.
We have mentioned that after having consumed excessive liquor,it would not have been possible for any one,much less for Vijay the deceased,to have written the said dying declaration with so much of precision or with steady hand, observed a Bench of Justices Deepak Verma and K S Radhakrishnan.
The five accused Nanhar,Virender alias Binder,Rampat,Rajbir and Umed Singh were serving life sentence for the murder of Vijay on February 27,2004. The prosecution argued that the alleged crime was an act of revenge as Vijay was suspected of having an illicit affair with the wife of one of the five men. They were convicted by the Bhiwani trial court.
The post-mortem report reveals that the deceased was 32 years old,5 feet 6 inches tall,with a robust body. It is inconceivable to believe that if the appellants would have tried to administer him alcohol mixed with poisonous substance,he would not have resisted to the same, the court gave its second reason for acquittal.
