A three-judge Bench of the Supreme Court confirmed to President Pratibha Patil that Saini and two of his members Mrs Santosh Singh and Ram Kumar Kashyap have failed to maintain the required standards of integrity and rectitude in performance of their constitutional duties.

Patils reference in July 2008 was backed by documentary proof furnished by the Governor, recommending the removal of Saini and eight members of the Commission.
