CHANDIGARH, Aug 11: A bench of the Central Administrative Tribunal has upheld the transfer of Karamjeet Singh of Police Telecommunications from Chandigarh to Delhi.

The applicant had stated that he had been working at Chandigarh since 1972 and was transferred only to accommodate three other persons who declined to move out of Chandigarh. Expressing personal difficulties, he alleged that his father had been paralysed and had lost his speech, his wife was undergoing treatment in Chandigarh and his three children were pursing studies in Chandigarh.

Further, refuting the defence of the respondents, that he was transferred from Chandigarh because he was rendered surplus, the applicant submitted that under such eventuality the junior-most employee should have been transferred while he himself was the senior-most.

The bench rejected the grounds of challenge and held that at the time of considering transfers, normally the seniority is considered and officials are transferred on first-come first-go basis. The applicant, being the senior-most person, would be the person to be chosen for the transfer.

It was further held that though it may be true that the petitioner would face some difficulties in managing the affairs of his family, these were grounds on which the tribunal could not interfere in the transfer orders.
