The Supreme Court today said it will examine the issue of non-exclusion of creamy layers within the backward classes from the benefit of reservation in government jobs and educational institutions in Tamil Nadu.
A Bench comprising Justice A K Mathur and Justice Dalveer Bhandari said it will look into the issue on the basis of the apex court judgment, which dealt the quota issue in Kerala. The court, on February 23, had set aside the report of a committee recommending raising of the annual income to Rs 2.5 lakh for exclusion of creamy layer from the backward class in Kerala for taking benefit of reservation.
The state government has contended that it was difficult to identify the creamy layer for excluding them from the benefit of reservation.
