Zaire national convicted after 9 years in drug case
NEW DELHI: The Supreme Court has upheld the conviction of a Zaire national, Kalematumba, nine years after his arrival at Sahar airport in Mumbai and arrest by Narcotics Control Bureau NCB for carrying a bag containing two kgs of heroin.
It was contended on behalf of him that NCB officers, who searched his bag, vitiated the investigation by not telling him that he had a right under Narcotic Drugs and Psychotropic Substances Act to be searched in presence of a gazetted officer or a magistrate. A division bench said this contention deserves to be rejected because only when the person of an accused is to be searched is he required to be informed about this right and in this case heroin was found from a bag belonging to the appellant and not from his possession.
