
The Supreme Court today lambasted the Centre for detaining three Pakistani prisoners in a Kashmir jail even after they have served 10 to 13 years for offences under several laws.
8216;8216;Set them free when they have served the sentences awarded to them,8217;8217; a bench of Justices Ruma Pal and P.V. Reddy said.
The observation was made during the hearing of a letter addressed to the court by Noor Mohammed and two other prisoners, alleging that they were in jail even after serving their sentences.
Additional Solicitor General Altaf Ahmad appearing for the Centre contended that they were 8216;8216;enemy aliens8217;8217; and had no fundamental right to be released even after serving the sentences.
He alleged that the Pakistan government had refused to take them back and it was not possible to release them. 8216;8216;Take them to Wagah border and release them. If they come back, you punish them,8217;8217; the court said.
When Altaf persisted, the court asked: 8216;8216;Why this farce of trial and conviction in this case then?8217;8217;
It appointed senior counsel K. Parasaran and advocate Bhim Singh as amicus curiae to assist the court and directed listing of the case on August 13. The court also directed the Centre to file copies of documents to indicate its efforts to deport the detainees.
