SC allows conditional desealing in Delhi
The Supreme Court allowed desealing of commercial premises in unauthorized colonies in Delhi on the condition that owners abide by its final order.
The Supreme Court on Wednesday allowed desealing of commercial premises in unauthorized colonies of the national capital on the condition that owners abide by its final order on the issue of legality of the Centre8217;s January 30 notification.
The notification had permitted the civic authorities to deseal the premises which were sealed in accordance with the Apex court8217;s earlier order.
While passing the interim order, a Bench headed by Justice Arijit Pasayat said in cases where the MCD has desealed the premises, owners have to give an undertaking within 10 days.
In cases where the premises are to be desealed, the owners will have to give an undertaking before the desealing process begins, the court said.
The Bench said a public notice should be issued for the purpose of implementation of the order, the format of which would be worked out in consultation with amicus curiae.
The court said the responses of the Centre, MCD, DDA and NDMC will have to be filed by the end of April in view of the changed circumstances.
If any other interested party wanted to filed an affidavit, it has to be filed by May 14, the court said and posted the hearing on the main matter for July seven onwards.
