IUCAA sues Mumbai firm for Rs 4.91 lakh
Prof Jayant Narlikar, director, Inter-University Centre for Astronomy and Astrophysics, has filed a civil suit claiming over Rs 4.9 lakh as damages from Lee and Muirhead Limited Ocean Freight and Groupage Multinational Forwarding, a Mumbai-based goods carrier company. The case is to come up for admission before principal civil judge S S Kande.

IUCAA had ordered four computer parts, described as 64 MB memory upgrade, from Parity Systems Incorporation, a computer firm based in the US. According to the contract between IUCAA and Parity Systems, the items were to be delivered on payment through the bank. The orders placed were dispatched by Parity Systems, USA and arrived at Sahar Airport via Berlington Air Express on February 3, 1996. IUCAA had engaged the services of Lee and Muirhead Ltd Ocean Freight and Groupage Multinational Forwarding for collecting the goods from the airport and delivering them to the IUCAA office in Pune.

The goods carrier company which also acts as a clearing agent was asked to collect and deliver the goods at the IUCCA office in Pune. “The documents were handed over to the defendant on February 23, 1996 and according to the contract, they were to be received at IUCAA within five days,” says Joshi. However, it is alleged that the parcel was delivered on March 25, 1996, about a month later.

When the container was opened in the presence of representatives of the board of IUCAA it was found to be empty, it is alleged.

Lee and Muirhead as well as Oriental Insurance Company were informed about the disappearance of the goods. When IUCAA lodged claims with the insurance company for loss of items, the claims were rejected as the goods were not collected from the airport within the specified 30 days.
