CHANDIGARH, July 21: The plea of Gurbax Singh who had retired as deputy director from National Institute of Sports, Patiala NIS to give him full pensionary and gratuity benefits for the entire period of service rendered with the State of Punjab and NIS has been accepted by a Bench of the Tribunal comprising judicial member Jasbir S Dhaliwal.

The applicant initially joined Police Department under Pepsu in April, 1949 subsequently merged under the State of Punjab. On the basis of his eligibility and suitability after he had qualified the 1st ad hoc course in volley ball, he was initially taken on deputation by NIS, Patiala in December, 1963 for a period of one year and subsequently after obtaining consent of the Police Department, he was absorbed permanently from December, 1964, after complying with all the requisite formalities i.e. formal resignation by the applicant from parent service, consent of Police Department etc.

The applicant was aggrieved of non-consideration of his service of 15 years 8 months under PEPSU and Government of Punjab for the purpose of grant of retiral benefits.

Considering the provisions of CCS Pension Rules, 1972, isued by Government of India, it was held by the Tribunal that the applicant was entitled to counting of his past service rendered in the Police Department under PEPSU.

Subsequently under the Punjab Government on joining the Central autonomous body, initially known as Society for National Institute of Physical Education and Sports, which later got amalgamated with the SAI, towards pensionary benefits and directed the respondents to take into account his service from April, 1949 to December, 1964 under PEPSU for calculation of benefits.
