CHANDIGARH, Nov 17: The objection petition, against quot;familyquot; property8217;s attachment by the court, filed by former UT chief engineer K.K. Jerath8217;s son _ Kapil Dev Jerath _ will come up for consideration before UT Judicial Magistrate Ist Class Jasbir Singh on November 26.
Today, seeking the framing of issues on the petition, the counsel for applicant, stated that certain points had to be proved by leading evidence.Earlier, objecting to the property8217;s attachment, the counsel had stated that the same could not be disposed as it belonged to a Hindu undivided family. Further, proper procedure for attaching the property had not been adopted by the court.
The Vigilance Department in their reply to the objection petition had, on the other hand, refuted the claim. They had stated that as per the records available with the Estate Office, the Sector 15 house was purchased by Jerath during an open auction in 1978.
The court, while declaring Jerath a proclaimed offender, had directed the attachment of his Sector 15 residence, along with two fixed deposit receipts on May 28. Currently under suspension, Jerath has been evading arrest after being booked by the Vigilance Department under the Prevention of Corruption Act.
According to the prosecution, kickbacks worth lakhs of rupees had been received by Jerath during his tenure as the chief engineer.
