No interim relief for Raj Thackeray

The Jharkhand High Court refused to give interim relief to Raj Thackeray who has challenged the jurisdiction of a local court to try a complaint case filed against him.

The Jharkhand High Court on Friday refused to give interim relief to MNS president Raj Thackeray who has challenged the jurisdiction of a local court to try a complaint case filed against him.

Posting the case for further hearing on November 28, the single Bench of Justice D K Sinha refused Raj’s counsel Y B Giri’s request that any coercive steps should not be taken against his client before the court completes the hearing.

Raj petitioned before the court on three counts-210 CRPC (a person cannot be prosecuted by different courts on the same offence), 177 CRPC (challenging territorial jurisdiction of the Jamshedpur court) and 317 CRPC (dispensation with personal appearance)-while challenging the lower court taking cognisance to the complaint case.

The MNS chief moved the High Court after a Jamshedpur court took cognisance and on September 30 issued a non-bailable warant on a complaint filed by an advocate, Hameed Raza, charging Raj with hurting religious sentiments.

However, Raj’s lawyer informed the Bench that his client was already facing charges in a court in Maharashtra and that he could not be punished twice for the same set of offence.

On the other hand, government advocate Rajiv Ranjan Mishra opposed Raj’s counsel’s request for an interim order against any coercive steps.
