
MUMBAI, SEPT 30: Though the London Bow Street magistrate had found prima facie evidence against Nadeem Akhtar, music director and prime accused in the Gulshan Kumar murder case, the Mumbai police have a long battle ahead before they hope to escort him to the city, admits Chief Public Prosecutor, Ujwal Nikam.
Addressing a press conference today, he said: 8220;Even if the magistrate rules that Nadeem should face trial on October 6, Nadeem can approach the High Court and then the British home secretary. After the home secretary, the case may again land up before a division bench of the high court on an appeal,8221; Nikam said.
8220;Fixing of the initial date for the hearing in the London High Court itself may take three to four months. Then the trial may continue,8221; Nikam added.
The London magistrate, Christopher Pratt, had ruled on September 22 that he finds that the Mumbai police has enough evidence against Nadeem which commits him to a trial. The defence, who had been harping on the retraction of the approverall along, discovered that the magistrate did not find the retraction credible.
After October 6, Nadeem will be given a fortnight to appeal against the judgement in the London High Court. However, Nikam is hopeful that the Mumbai police can get the appeal overturned in the high court.
