
PUNE, DECEMBER 10: The application of Pappu Kalani MLA and eight others, seeking discharge from the provisions of TADA against them, was rejected by the designated TADA Court Judge A S Rane here on Thursday.
Kalani and others have been accused of shooting one Anna Shetty on October 15, 1990, over old enmity.
Shetty was allegedly shot dead at the behest of Kalani in Ulhasnagar in Thane district. One of the accused is a police inspector, who is also alleged to have helped Kalani.
The conspiracy to eliminate Anna Shetty was allegedly hatched on October 13, 1990, and executed two days later after Shetty was released on bail from Adarwadi district jail of Kalyan.
The accused filed an application under section 227 of the Code of Criminal Procedure for discharge.
The defence counsel submitted that the provisions of TADA were applied against the accused after two years of Shetty8217;s murder. The case, at the best, would fall under provisions of section 302 of Indian Penal Code and not TADA, he argued.
The prosecution said the intention of the accused was not only to murder Shetty but also to create a reign of terror. Hence the provision of TADA was applied against the accused, he said.
