CHANDIGARH, march 1: UT Consumer Disputes Redressal Forum has directed the commissioner and secretary to Government, Haryana Town and Country Planning and Urban Estates Department, special secretary, Town and Country Planning, Administrator, HUDA Gurgaon and Estate Officer, HUDA, Gurgaon to pay Rs 40,000 compensation to J.K. Duggal for not having allotted him the original plot, for which he had already paid the tentative, as well as the enhanced price.

The complainant stated that he paid Rs 1.10 lakh, the tentative price of plot number 656 in Sector 21, Gurgaon, which was allotted to him. He also paid the enhanced amount of about Rs 74,000. The complainant wrote letters to the opposite parties for allotment of the said plot, but he later received a letter from the respondents stating that the allotment could not be made because the said plot was not available at the site after demarcation.

It was added that the complainant can have an alternative plot, the total price of which came to about Rs 4.52 lakh. The respondents, in their reply, stated that price of the alternative plot had been demanded as per HUDA8217;s policy after adjusting the amount deposited against plot number 656.

After hearing the contentions, the Forum bench, comprising president H.C. Mosi and members R.K. Behl and Shashi Kanta, stated that had the respondents given the originally allotted plot or in its place the alternative plot at the same rate, the complainant would not have been put to inconvenience.

It was thus stated that the complainant be compensated to the tune of Rs 40,000. Directions were also issued to the opposite parties for not charging anything more than the price of the plot originally allotted to the complainant while offering the alternative plot.
