
A day after the Mayawati Government decided to withdraw 189.25 hectare of land it had given for a rail coach factory at Lalganj in Rae Bareli, the Lucknow Bench of the Allahabad High Court on Monday ordered status quo in the matter.
The Bench, comprising Justice Pradeep Kant and Justice S Hasnain, passed the order on a petition filed by the Railway Ministry and a PIL filed by two villagers 8212; Dinesh Chandra Mishra of Ahar village and Avindra Pandey of Balemau 8212; challenging the state Government8217;s action.
The Bench, which clubbed the two petitions, however, refused to stay the state Government8217;s order of October 11 through which it withdrew the land from the railways. The Bench fixed the next hearing for October 22.
Interestingly, the opposing counsels claimed that the order was in their favour. While Md Arif Khan, counsel of the villagers who filed the PIL, claimed that the status quo meant the land would remain in the possession of the railways, chief standing counsel of the government Devendra Upadhyay claimed that the status quo meant that the land would remain with the Gram Sabha.
