
CALCUTTA, Feb 4: The Calcutta High Court today dismissed a petition seeking setting up of a judicial inquiry into the mass killing8217; of Naxalites, including their leaders Charu Mazumdar and Saroj Dutta, between 1968 and 1972.
A division bench comprising Justices T K Chatterjee and B M Mitra in their judgement said the purpose of such an enquiry was rendered futile8217; by the lapse of time and erosion of material and evidence required to probe into the points raised by the petition.
The bench also observed that earlier, the Chakrabarti Commission, set up by the State Government to inquire into the matter, was quashed by the High Court as the commission was not set up on the basis of adequate material.
A public interest litigation filed by the son of the late Charu Mazumdar and Sujato Bhadra of the Association for Protection of Democratic Rights APDR in September last year alleged that the 8220;encounter era of this country began with the mass genocide of the Naxalites by the state police at various placesduring the period 1968 to 1972.8221;
The petition also alleged, 8220;All senior police personnel and personnel manning the state administration overtly and covertly conspired and executed the8230; mayhem and murder of the Naxalite activists and their leaders in the name of maintenance of law and order.8221;
Bhadra, however, told The Indian Express the APDR will move the Supreme Court to appeal against the High Court ruling dismissing the petition.
