Apex court remits case back to High Court
In a significant decision, the Supreme Court of India has set aside the orders passed by former Chief Justice of Punjab and Haryana High Court V K Jain in relation with a petition on Dera Sacha Sauda.
The senior standing counsel, Advocate Anupam Gupta, and the former Chief Justice had, earlier, entered into a war of words on the issue. Gupta had challenged the issuance of notices to the UT Administration by Jain.
Owing to the verbal argument, Jain had sought explanation from the Home Secretary and directed him to file an affidavit explaining as to on whose recommendations or directions, Gupta had taken up the argument with Jain. An affidavit, explaining that the contentions raised by Gupta were not dictated by anyone, was filed by the UT Home Secretary in the High Court.
Not satisfied with the affidavit, Jain had directed the UT Administrator to file his affidavit in this regard. Aggrieved by the order, the UT Administration moved the Supreme Court challenging the order.
The Supreme Court had, meanwhile, granted a stay over the hearing of the petition in the High Court. On Thursday, a Division Bench of the Supreme Court set aside the orders passed by Jain and remitted the case back to the High Court for hearing.nbsp;
