VADODARA, Oct 14: Civil Judge, senior division, Narendra Naik, after hearing the arguments of petitioners and defendants in the debarred admission case in the M S University8217;s Arts faculty on Thursday, fixed the date of judgment for October 27.

Arts students Janak Makwana and Mihir Upadhyay had filed a petition before the court terming the M S University8217;s decision to debar them from admission as trampling on their fundamental right to education. The petition came up for hearing on Thursday.

Appearing on the students8217; behalf, advocate Narendra Tiwari contended that the students8217; grievance committee, which decided on the debarment, had been constituted to look into the grievances of the students and not to take action against them. Tiwari further stated that merely on the basis of the complaint lodged with the police by the MSU, the students cannot be debarred from admissions. 8220;The Deans cannot decide whom to give admission and whom not to give,8221; Tiwari contended.

Further, the petitioners said that the decision to debar the students was taken despite the fact that the Syndicate was yet to give its verdict on the issue. Tiwari also claimed that the MSU stand was self-contradictory. 8220;On the one hand they said that they had taken the decision to send across a stern warning to other students, but on the other hand no record about the decision was produced before the court,8221; Tiwari contended. The university authorities wanted to make out a case against them to prevent them from winning the student union elections, due to be held in November, the petition alleged.

Appearing on behalf of the MSU, advocate Mehul Mehta stated that there were clear Supreme Court and High Court rulings that the subject of admission cannot be decided by the courts and should be done by the concerned authorities.

On this Tiwari contended that the MSU could be an autonomous body but cannot be an autocratic body. 8220;Besides, we have prayed for acceptance of admission forms of the students and not admitting them. Let the MSU decided on merit after accepting the form,8221; Tiwari stated. After hearing the arguments and counter arguments, the court slated the judgment in the case for October 27.
