Court upholds punishment for offence committed 13 years ago

CHANDIGARH, May 27: City-based Girish Kapoor, booked way back in 1986 under the Customs Act, was today held guilty of the offence by UT District and Sessions Judge B.S. Bedi.

After hearing arguments in the case, in which one of the two accused had been declared a proclaimed offender and has yet not been traced by the police, the Judge dismissed Kapoor8217;s appeal against the February 14, 1996 judgment of the then Chief Judicial Magistrate Shekhar Dhawan who had sentenced him to one year rigorous imprisonment and Rs 1,000 fine. The CJM had further directed him to undergo one month RI in case of default of payment of fine.

It8217;s interesting to note that the case against two city residents was registered 10 years ago on the complaint of Assistant Collector, Central Excise Division, under Sections 135 1 b and 135 2 of the Customs Act, 1962. Kapoor had been found to be in unlawful possession of foreign goods worth about Rs 62,000.

The recovery had been made in a raid conducted in Kapoor8217;s Sector 15 residence by the Central Excise Preventive Party and Kapoor had failed to produce documents to show that the goods had been lawfully imported.

The case was also registered against Nirmodh who, according to the accused, was the actual owner of the goods. Nirmodh had, however, been declared a proclaimed offender.
