
A Sessions Court on Wednesday sentenced a man for two years8217; rigorous imprisonment for cheating a woman by making false promise of marrying her.
The court held the accused, Joshimuddin Mojumullah, guilty of cheating and establishing physical relation with the woman with a fake promise.
The complainant, while staying with her brother, had developed friendship with Mojumullah, a neighbour. When their friendship grew in to love, they decided to get married. But Mojumullah back tracked and did not keep his promise. According to police, in September 2006, when the complainant had gone for her medical check-up, she discovered of her being seven month pregnant.
The woman8217;s brother then spoke to Mojumullah and asked him to keep his word of marrying her but the latter refused. Later, the family filed a complaint of rape and cheating against Mojumullah at RCF police station. Mojumullah was subsequently arrested and sent to custody.
Public prosecutor Kiran Makasare examined six witnesses in all including the complainant8217;s family members. Though a case of rape was registered against the accused, the charge was later altered as the prosecution could not prove the case of non-consensuality. The accused was convicted on charges of cheating under section 417 of the IPC and fined Rs 20,000.
