PUNE, Dec 7: The Additional District Consumer Desputes Redressal Forum here has asked a Mumbai-based builder to pay a fine of Rs 4.9 lakh to Shrikant Gajanan Pawar of Khadki for deficiency in service.

The order was passed by president K D Pawar on a complaint filed by Pawar against the proprietor of National Construction and Space Designer, Praveen Ghole Patil, who has a branch office in city.

Pawar had alleged deficiency in the construction of his bungalow at his native place Patan.

According to the complaint, Pawar had appointed town planner Patil as his attorney-cum-advisor who was to receive 10 per cent of the gross value of all items of building and civil works as his professional fee. On the day of giving him his appointment letter, Patil was paid Rs 5,000 in cash and a cheque of Rs 55,000. Altogether, he was made a gross payment of Rs 4 lakh between December 6, 1995 and February 1, 1996. Later a memorandum of understanding was made where the opponent neither showed his intention either to construct the proposed house or to treat the amount of Rs 4 lakh as advance loan. As per the MoU the opponent did not provide post-dated cheques to the complainant.
