Arushi murder: Talwar8217;s bail plea to be heard on Friday

The bail plea of Dr Rajesh Talwar is coming up in the Ghaziabad court on Friday in the Arushi-Hemraj murder case. The prosecution will be fighting for the extension of his judicial custody.

Talwar8217;s bail plea had been rejected by the sessions court on June 26, after the CBI claimed that they had reasonable grounds to suspect his involvement in the double murder on May 15. His lawyers had argued that no incriminating evidence was found against him, but the court had rejected the plea.

Talwar8217;s lawyer S Tamta told Newsline: 8220;The bail application is under process and we are waiting for the hearing on Friday; the decision on filing the application will be taken after that.8221;

The lawyers say the hearing will be crucial as there has been news in the media about a leak of information on some confessional statements. But they are yet to file a bail application in the Allahabad High Court.

Sources in the CBI, meanwhile, said that they still do not have substantial evidence against Talwar to nail him.

Talwar8217;s lawyers have already argued that the CBI has no evidence against him till date, except for a statement taken by the agency officials under Section 161 of the Criminal Procedure Code, whereby he was to help the probe agency in finding out the evidence in the crime.

Talwar has been in jail ever since the Noida police arrested him on May 27 as the prime suspect. The case had later been handed over to the CBI and the investigation agency has questioned the Talwars, their friends the Duranis, and arrested Talwars8217; compounder Krishna and Duranis8217; domestic help Rajkumar.

Other domestic helps of the neighbourhood and friends of Arushi have been questioned.

Other people questioned in the case include Hemraj8217;s son-in-law Jeevan Sharma, eight officers of Noida police who had investigated the case, retired policeman KK Gautam, and senior officers of Uttar Pradesh police, who were in-charge of the investigations.

The CBI has also gathered forensic evidences including fingerprints from the spot. Narco-analysis tests of Talwar and several others have been done. The report of narco-analysis test of Raj Kumar is still awaited.

The agency, however, has failed to gather enough evidence and also find the murder weapon.
