CHANDIGARH, Oct 14: UT Additional District and Sessions Judge S.S. Lamba here allowed anticipatory bail plea filed by the manager of a finance company who allegedly took away the petitioner’s vehicle when the latter failed to pay the due installments.

Sanjiv Kumar, manager, MGF Finance, was booked here by the city police on October 12, under Section 382 of IPC.

Complainant Arvind Pal Singh stated that Sanjiv Kumar issued some loan to him which he could not pay due to some unavoidable circumstances. He stated that he had paid some installments but could not pay the remaining sum.

It was alleged that the accused threatened to lift and sell his vehicle in case he did not make the payment. Apprehending trouble he approached the civil court and took stay on the matter till October 25. He alleged that on October 8 his vehicle was lifted. The petitioner took the plea that the accused violated stay orders issued by the court and should therefore not be granted stay from arrest.

The Judge, however, held that violation of stay orders is not very significant in the said context and allowed anticipatory bail application of the accused, further holding that in case of arrest he would be released on bail bond of Rs 5,000 and a surety in the like amount.

Bail denied in dowry case
Bail application of Pardeep Kumar, accused of harassing his sister-in-law for bringing insufficient dowry was today declined by UT Additional District and Sessions Judge R.C. Godara. Victim Anita had committed suicide here on October 10, 1998, after being allegedly harassed for dowry by her in-laws.

Pardeep Kumar had earlier also been declined bail by ADJ S.S. Lamba. He was booked along with his family members on October 11, 1998 under sections 498 A, 304 B and 120 B of IPC. Others who were booked were Pushpa (mother-in-law), Deepak Kashyap (husband), Vinod Kashyap (brother-in-law), Indu Sharma and Madhu Chandel (sisters-in-law).

As per the father of the deceased, the complainant in the case, Anita was married to Deepak on July 19, 1998, and was given sufficient dowry. He stated that on August 14, 1998, Anita came to her parents’ house and said that her in-laws were demanding a car and more jewellery from her. It was stated that she stayed with her parents till August 21 and in this period no one from her matrimonial home came to visit her.

Finally she was dropped at her in-laws’ house and later, on October 10, 1998, it was known that Anita had committed suicide.

Though Pardeep Kumar furnished a ration card to prove that he was living away from his brother, the Judge held that entries in the card do not prove the same. Considering this, the bail plea was rejected.
