On March 28, the High Court had ordered a CBI probe into the alleged attack during Pramanik's visit to his constituency in Cooch Behar on February 25. The Supreme Court on Thursday set aside Calcutta High Court order directing a Central Bureau of Investigation (CBI) probe into allegations of an attack on the convoy of Union Minister of State for Home Affairs Nisith Pramanik in Cooch Behar.
Sending the matter back tot the HC, an apex court bench headed by Chief Justice D Y Chandrachud asked the high court to look afresh into an additional affidavit of the West Bengal Police on the status of the probe and decide whether a CBI probe was needed, news agency PTI reported.
During the hearing, Chief Justice of India D Y Chandrachud said, “The HC did not apply its mind to the entire facts. Thus, we find it appropriate to remit the matter back to HC to apply its mind afresh… We clarify that we leave open the question of the petitioner concerning maintainablity. We allow the appeal and set aside the judgement and restore writ petition before HC to be considered afresh.”

The high court had passed the order on a PIL filed by LoP in West Bengal Assembly, Suvendu Adhikari, seeking a CBI probe into the attack alleging a conspiracy to “cause bodily harm” to Pramanik.
