Rape survivor ‘sexually assaulted’ by magistrate in Tripura, 3-member probe panel formed

The rape survivor was allegedly sexually assaulted by a magistrate in his chamber when she went there to register her statement as per Section 164 of the Code of Criminal Procedure

A rape survivor in Tripura’s Dhalai district has alleged that she was sexually assaulted by a magistrate in his chamber when she went there to register her statement as per Section 164 of the Code of Criminal Procedure.

In a written statement available with indianexpress.com, the woman said, “I was summoned to record my statement… in the chamber of the first-class judicial magistrate. After I reached there, the judicial magistrate asked me to go into his chamber alone and asked the woman police personnel to stay outside. The judge closed the door behind me and asked me to narrate what happened to me. I gave statements… when he asked me to stand up and groped me and sexually assaulted me.”

A senior police officer said the woman was allegedly raped on February 13 by a 26-year-old man at her residence. She was summoned to the judicial magistrate’s office to give her testimony on February 16, when she was allegedly sexually assaulted by the judge.

A complaint has been registered in this regard by the woman’s husband, who said, “I’m a daily wager. If a judge mistreats us, how would people get justice.”

A three-member panel headed by a district and sessions judge has been formed to investigate the incident.

Speaking to indianexpress.com, a lawyer said, “A complaint was addressed to the secretary of our bar association. Our president received the complaint. We forwarded the complaint to the additional district judge.”
