Meanwhile, Rajya Sabha passed the Central Goods and Services Tax (Second Amendment) Bill, 2023 and the Provisional Collection of Taxes Bill, 2023.
Union Home Minister Amit Shah spoke on the criminal bills and majority of MPs present in the Lower House voted in favour of the bills by voice vote. Referring to IPC, CrPc, Indian Evidence Act, Shah said, “New criminal law bills will free people from colonial mindset..The three laws were made during the time of English..Till the laws are not repealed, the UK laws will continue in the country… Her Majesty, London Gazette, British Crown and barrister terms continue to be used in India because of the laws.”
Meanwhile, earlier in the day, two MPs from Kerala namely – Thomas Chazhikadan and AM Arif were suspended from the Lok Sabha on Wednesday, taking the total number of suspensions in both Houses to 143. Jagdeep Dhankar, vice-president said he would not tolerate any insult to Parliament and the post of vice-president while expressing deep anguish over a TMC MP mimicking him in the parliament complex. “You can insult Jagdeep Dhankar all you want but not the Vice President of India,” he said. Dhankhar said that he would not tolerate it if the dignity of his office was lowered. Prime Minister Narendra Modi also called Dhankhar expressing great pain over the “abject theatrics” of some MPs in the Parliament complex yesterday.

The Opposition parties have insisted that the Home Minister make a statement addressing the security breach. The government’s stand is that the security of Parliament is a sensitive matter. It comes within the purview of the Lok Sabha secretariat, and the government will follow the directions of the Speaker, Om Birla, in this regard. The Speaker has informed the House that a high-level committee is investigating the matter. And some of the suggestions provided at an all-party meeting have been implemented.
The standoff in Parliament is not new. Irrespective of a political party/ alliance’s role in our national legislature, a familiar story has played out over the years. Parliament witnessed a slew of suspension of MPs in a similar way in 1989. The 63 MPs were suspended when Rajiv Gandhi was Prime Minister. With more than 400 MPs, the Congress government then enjoyed a brute majority, much like the BJP now.
On March 15, 1989, the Lok Sabha witnessed an uproar over the tabling of the Justice Thakkar Commission of Inquiry into the assassination of former Prime Minister Indira Gandhi [a commission of inquiry under Justice MP Thakkar, set up in 1984]. This led to the suspension of 63 MPs in one go, the highest ever. According to a PRS Legislative Research report, after the suspension, “An Opposition member belonging to the Janata Group (Syed Shahabuddin) who had not been suspended, submitted that he also be treated as suspended and walked out of the House. Three other members (GM Banatwalla, MS Gill and Shaminder Singh) also walked out in protest.”
However, the key difference is that these MPs had been suspended for the remainder of the week, which was three days, while this time, the lawmakers have been barred for the remainder of the House session. Also, the 1989 suspension was revoked a day later, after the members apologised to the Speaker.
In 2015, when Congress was protesting the suspending of its members, then Parliamentary Affairs Minister Venkaiah Naidu had reminded the party of the 1989 incident. “If Congress claims that suspension of 25 of its MPs is a black day for democracy, who set the record and the benchmark?” Naidu had asked. There is an old tradition, irrespective of which party or alliance is in opposition, of MPs causing a ruckus inside Parliament. “Over the years, four broad reasons have been identified for disorder in legislatures,” Chakshu Roy, head of outreach at PRS Legislative Research, wrote for The Indian Express in 2022.
These are i) the lack of time available to MPs for raising important matters, ii) the unresponsive attitude of the government and retaliatory posture by Treasury benches, iii) deliberate disruption by parties for political or publicity purposes, and iv) the absence of prompt action against MPs disrupting Parliamentary proceedings.
Over the decades, the say the Opposition has in deciding the Parliamentary calendar has been reducing. Not only does the Government set the agenda in Parliament and decide how much time will be dedicated to any issue, Parliamentary procedure also prioritises government business over other matters.
So, who can suspend the MPs? How?
The Presiding Officer — the Speaker of LS and Chairman of RS — plays the major role in meting out suspensions. In Lok Sabha, the Speaker acts in accordance with Rules 373, 374, and 374A of the Rules of Procedure and Conduct of Business. In Rajya Sabha, the Chairman acts as per Rules 255 and 256 of the Rules. The procedure in both Houses is largely similar.
First, the presiding officers can direct an MP to withdraw from the House for any disorderly conduct (Rule 373 in LS, 255 in RS). If that does not work and the said MP continues to disrupt the House proceedings, the presiding officer can “name” the legislator (Rule 374 in LS, 256 in RS). After that, the House can move a motion to suspend the MP until the end of the session. Read more

On the anniversary of the 2001 terror attack on the Parliament of India, the security of the new Parliament building was breached. The government sought first to downplay the incident, probably because the breach was explicitly facilitated by the office of one of the MPs of the BJP. The disquiet among the Opposition members grew because Home Minister Amit Shah, who seems to have an opinion on virtually every subject under the sun, did not deem it important to appraise Parliament about the security breach and the measures taken by his ministry in response. In his shocking refusal to make a statement on the floor, the home minister has displayed what can only be called a willful dereliction of national duty.
Astoundingly, a large number of MPs who were expressing their concern and pressurising the government to give up indifference on a matter of national security have been suspended. The suspensions this week follow an already strong trend of excluding and targeting MPs whose voices have helped focus the nation’s attention on matters of grave socio-legal and economic concerns — discipline and propriety seem a cover. While safeguarding the dignity of the House and maintaining discipline is an important prerequisite of democratic parliamentary functioning, we must ask ourselves what this requirement is aimed at.

Parliament Winter Session 2023 Live Updates: Not the first time, Kalyan Banerjee has a long, bitter history of targeting Dhankhar
Trinamool Congress MP Kalyan Banerjee, whose mocking mimicry of Rajya Sabha Chairperson and Vice-President Jagdeep Dhankhar has caused a stir, has a long history of using pejorative language to target Dhankar during the latter’s tenure as West Bengal Governor between 2019 and 2022.
Dhankhar’s stint in West Bengal was marked by bitter exchanges with the TMC, the state government, and Chief Minister Mamata Banerjee, and Kalyan would often be at the forefront of the attack on the then Governor.
Kalyan’s actions, though, are not exactly new.

Parliament passed the Central Goods and Services Tax (Second Amendment) Bill, 2023 to raise the age cap of president and members of the GST Appellate Tribunals to 70 years and 67 years, respectively.
?Replying to a short discussion on the bill in the Upper House, Finance Minister Nirmala Sitharaman said the amendment has been brought as suggested by the Chief Justice of India.
? She said the finance ministry was "rightly alerted" and also advised by the Supreme Court of India's Registrar on the suggestions of the Chief Justice of India that amendments to the legislation will have to be in alignment with regulations for other tribunals.
? "Since it was a valid suggestion and pointed out by the Supreme Court, we quickly thought it was important for us to respond and we responded in time. Therefore, we have come up with these two amendments," Sitharaman said.
? The minister also replied to queries and suggestions made by Rajya Sabha members during the discussion. She said that before GST, people used to pay very high prices for daily-use commodities. But after the introduction of GST, prices of daily items like toothpaste, brush, and hair oil, have come down, the minister said.
? Some members had suggested that petroleum products should be brought under the ambit of GST. In response, the minister said, "I wish the state governments see the point and eventually customers will pay less tax if the GST is brought in, the overlapping, the doubling of tax will not be there".
? The finance minister also sought to assure the House that the central government was responding speedily to the situation arising out of floods in four districts of Tamil Nadu. "I assure the people of Tamil Nadu that Prime Minister Narendra Modi will be there whenever you need," she said. The minister also added that because of the speedy response of the home minister, the state got rescue helicopters, boats, medicines, and other assistance in time.

Opposing the three criminal Bills, AIMIM’s Asaduddin Owaisi said in Lok Sabha Wednesday: “These three criminal Bills are themselves felonious. Instead of preventing crimes they are an attempt to give legal cover to the government’s crimes. The irony is that the people who are facing charges of terrorism are also defining terrorism.”
Had Bhagat Singh and Mahatma Gandhi been alive today, they would have called these three laws the Rowlatt Act, Owaisi said. “The reality is that there is no greater punishment for the poor, the Dalit and Muslims in this country than their very lives. If we wanted to reform the laws, then we should have removed those provisions which allow the government and the police to act as they will. The maximum number of undertrials in the country today are Muslims, Dalits and tribals,” he said. He also spoke about extended police custody and stringent bail conditions in the Bills apart from the offence of sedition being reframed.

? It repeals The Provisional Collection of Taxes Act, 1931. While moving the bill for passage on Tuesday, Finance Minister Nirmala Sitharaman said the bill sought to obtain the authority from Parliament to provisionally levy and collect the newly imposed or increased duties of customs and excise for 75 days.
? While the changes in rates of income and corporate taxes, incorporated in the Budget announced on February 1, are effective from April 1 or a notified date, most of the changes in customs and excise duty rates become effective from midnight.

? He said the existing criminal laws – Indian Penal Code (IPC), Indian Evidence Act and the Code of Criminal Procedure (CrPC) - were reflective of the colonial mindset with the intention to punish and not impart justice.
? "The three news bills seek to establish a justice system based on Indian thinking... Three proposed criminal laws will free people from colonial mindset and its symbols," Shah said.
? "For the first time, the criminal justice system will have the human touch. Till we repeal these old laws, we are still following laws made by the UK government. We still use English words like Her Majesty, British Kingdom, the crown, barrister, ruler after 75 years of independence," Shah said.
? The home minister said the colonial-era laws prioritised acts of "looting the treasury", "uprooting rail tracks" and "insult to the Crown" over crimes against women and children, human rights, border security, and the army.
? The old laws had listed rape under Section 375-376, the new bill has the crime listed under Section 63, murder was listed under Section 302 now it is Section 101, kidnapping was under Section 359 and now it is Section 136, Shah said.
? Listing the features of the bills, he said, "This bill punishes mob lynching with death penalty. (Congress leader P) Chidambaram kept asking me what about mob lynching. He does not understand BJP and our mentality. Why did you not penalise mob lynching during your rule? If one's mind is Indian, you will understand the laws. If it is Italian, you won't."

The Congress on Wednesday said the "entire Modi ecosystem" is now being galvanised on the "so-called mimicry non-issue" while it remains silent on how a BJP MP "facilitated entry of two intruders" into the Lok Sabha and on the suspension of over 140 MPs.
The opposition party hit back at the BJP for its criticism of a TMC leader's mimicry of Vice President Jagdeep Dhankhar, saying a "desperate attempt" is being made to divert attention from the unprecedented suspension of MPs by raising this issue.
In a post on X, Congress general secretary Jairam Ramesh said, "The entire Modi ecosystem now being galvanised on the so-called mimicry non-issue, while it remains silent on the real issue of why and how a BJP MP from Mysuru facilitated entry of two intruders into Lok Sabha on December 13th '?who are now charged under the anti-terror law UAPA." "The entire ecosystem is also silent on the summary suspension of 142 MPs for making a perfectly legitimate demand," he said.
In another post earlier on X, Ramesh alleged that a desperate attempt is being made to divert attention away from the unprecedented suspension of MPs by raising the issue of 'mimicry'.

Congress president Mallikarjun Kharge on Wednesday said caste should not be dragged into every issue and wondered if he should rake up his Dalit origins every time he is not allowed to speak in Rajya Sabha, amid a row over the mimicry of Vice President Jagdeep Dhankhar.
Dhankhar, who is also Rajya Sabha Chairperson, has flayed the mimicry, calling it as an insult to his background as a farmer and 'Jat' (his caste). The ruling BJP has echoed a similar view.
Speaking to reporters, Kharge said the Chairperson's job is to give protection to other members but he himself is making such a statement.
"I am not allowed to speak in Rajya Sabha often. Should I say it is because I am a Dalit," he added. They should not incite people outside in the name of caste by talking about it inside, he said. (PTI)

A day after a video from the Parliament complex showing Trinamool Congress leader Kalyan Banerjee ostensibly mimicking the Rajya Sabha Chairman and Vice-President Jagdeep Dhankhar, President Droupadi Murmu and Prime Minister Narendra Modi on Wednesday criticised the incident and expressed their pain at the way things unfolded.
“I was dismayed to see the manner in which our respected Vice President was humiliated in the Parliament complex,” President Murmu posted on X on Wednesday.
“Elected representatives must be free to express themselves, but their expression should be within the norms of dignity and courtesy. That has been the Parliamentary tradition we are proud of, and the People of India expect them to uphold it,” the post said. (Read More)

It is a disgrace and a blot on our democracy and i am ashamed that those in power in our country would allow this to happen. When a Parliament security breach occurs, it is the responsibility of the Union Home Minister to come and address the Parliament. Various things he was saying to the outside media could have been said inside the Parliament," Congress leader Shashi Tharoor said on Wednesday.

Dhankhar told the prime minister that such incidents will not deter him from doing his duty.

Parliament winter session: NGOs got Rs 55k cr from abroad in 3 years
More than Rs 55,000 crore in foreign contributions were received by over 13,500 FCRA registered NGOs in the country in three financial years (2019-22), Lok Sabha was informed on Tuesday.
Union Minister of State for Home Nityanand Rai said in order to accept foreign contributions, all associations or NGOs have to obtain registration or prior permission under the Foreign Contribution (Regulation) Act, 2010 (FCRA, 2010).
“A total of 13,520 associations or NGOs have received a total of Rs 55741.51 crore foreign contribution in the last three financial years; 2019-20 to 2021-22,” he said in a written reply. (Read More)

Lok Sabha Secretariat circular bars suspended MPs from entering Parliament chamber, lobby and galleries
The Lok Sabha Secretariat on Tuesday issued a circular which stated that the suspended MPs were barred from entering the Parliament chamber, lobby and galleries.
“They stand suspended from sittings of Parliamentary Committees of which they may be a member and no notice tabled by them is acceptable during the period of their suspension,” the order stated. They would also not be entitled to the daily allowance as long as their suspension continues.
