Adnan Sami gets anticipatory bail from High Court

The Bombay High Court granted anticipatory bail to Adnan Sami in connection with the harassment case.

The Bombay High Court granted anticipatory bail to Pakistani singer Adnan Sami in connection with the harassment case filed by his wife.

Sami will have to produce two sureties of Rs 15,000 to get bail if arrested. He will also have to surrender his passport after his foreign tour. Sessions court had last week rejected Sami’s anticipatory bail application, but granted anticipatory bail to his parents. He later moved High Court.

Sami’s wife Saba Galadari had filed complaint with the suburban Oshiwara police station alleging that he was subjecting her to cruelty and was blackmailing her.

She alleged that Adnan possessed a VCD and some photographs which showed her in compromising position and had threatened to circulate them if she did not return the flats he had gifted her.

Prosecution,as well as Saba’s own lawyer argued in the High Court that police needed to question Adnan to find out the photographs.

However,Sami’s lawyers Vibhav Krishna and Amit Desai said that there were no such photographs and the VCD has been deposited with the sessions court, they said.

Justice Mrudula Bhatkar, while granting anticipatory bail to Adnan, noted that there was only “apprehension” of misuse of alleged photos, not any actual instance.

Justice Bhatkar noted that though there were six non-cognisable cases of assault filed by Saba against Adnan, there were no medical records to back them, and cases might be “offshoots” of their dispute.

The alleged photos were taken with Saba’s consent (when their relations were good),as per her own admission, court said.

Court also noted that Adnan,a Pakistani national, was living in India since 1993.

Court asked him to surrender his passport, but before that he has been allowed to go to Canada for a pre-scheduled tour. Thereafter,he will have to seek lower court’s permission if he wants to go out of the country.

The court also warned the singer not to display/circulate any photographs of Saba,or tamper with evidence,or pressurise witnesses.
