NEET UG 2024: Supreme Court seeks NTA response over OMR-related issues

The Supreme Court on Thursday sought a response from the National Testing Agency (NTA) asking if there was any time limit to raise grievances regarding the OMR sheets for the National Eligibility cum Entrance Test-Undergraduate candidates, who appeared for the NEET-UG 2024.

A bench of Justices Manoj Misra and S V N Bhatti said this while issuing notice on a plea made by a coaching institution, Xylem Learning Private Limited, and a few NEET candidates.

Appearing for the petitioners, senior advocate R Basant said that several students were aggrieved as they were yet to get their OMR sheets.

He added that some of the OMR sheet calculations are “inconsistent with the calculations done with the answer key”.

During the proceedings, the bench noted as to how can a coaching institution file a petition under Article 32 and how their rights were “violated”.

The bench remarked: “How their fundamental right was violated so as to necessitate a writ petition under Article 32”.

Justice Bhatti remarked, “This is one of the reasons where we see this role played by the coaching centres, bagpipers. They have hardly any role to play…If they have discharged their service, that is the end of the matter. They have not undertaken to see that everything that centre is supposed to do, it will be taken care of by them”.

Appearing for the NTA, advocate Vardhman Kaushik said that OMR sheets had already been provided to the candidates.

The bench then sought to know “if there was a time limit to approach the authorities regarding the grievances over OMR sheets.”

“Normally in such matters if OMR sheets are uploaded and if there is any grievance, then there is a time limit,” said Justice Misra.

The NTA counsel said he needs to take instructions on what exactly is the position and sought listing of the petition along with the pending matters.

The court tagged the petition with the pending NEET related matters and listed it for hearing on July 8.
