Additional sessions judge S M Shinde has rejected the bail plea of Sham Dabhade — one of the main accused in the murder of RTI activist Satish Shetty.

Through his lawyer Sudhir Shah,Dabhade had applied for bail on grounds of parity as the other two accused, advocate Vijay Dabhade and Pramod Waghmare, were granted bail by the Bombay High Court. Dabhade said in his application that he was falsely implicated in the murder case as he was in Rajure village in Akole when the incident took place and that his cellphone details had confirmed the location. He also said his description given in the FIR did not tally and that he had no enmity with Shetty.

CBI prosecutor Ayub Pathan told the court that Dabhade was one of the main conspirators and that eye witnesses have identified him in the court. He also said police had seized one country-made sten gun,22 bullets,2 choppers, one scythe, nine mobile handsets and 16 SIM cards from Dabhade. “He has been a habitual offender and has spread terror in Talegaon and around. He is likely to abscond if released on bail,” he said.

After hearing both the sides, the court said there were many other criminal cases pending against him. It also said the cellphone tower location is not enough to establish his alibi.
