Five more officials of Lavasa Corporation Limited were recently granted exemption from personal appearance before chief judicial magistrate (CJM) N T Ghadge. With this,all the 14 officials summoned in November 2011 by the CJM court,have got exemption.
In January nine promoters and directors,including Ajit Gulabchand,Anuradha Desai,Gautam Thapar,had got exemption.
On November 24 last year,the court had issued process and summoned them under section 15 (penalty for contravention of provision of Environment Protection Act and rules,order and directions) read with section 16 of Environment Protection Act,1986. The maximum punishment under section 15 is five-year imprisonment or a fine of upto Rs 1 lakh or both.
The judge had issued the order hearing a private criminal complaint filed by the Maharashtra Pollution Control Board (MPCB) on November 4,as per directions of the Bombay High Court. MPCB regional director P K Mirashe is the complainant in the case.
In October,the directors had approached the Bombay High Court against the summons of the Pune court.
