Judicial Magistrate (first class) S M Padalikar on Tuesday granted permission to the Yerawada police for arresting Mathew Yanmal,head of Gurukul Godavari Balak Ashram,under Sections 23,26 and 28 of the Juvenile Justice (care and protection of children) Act 2000,as demanded by the Pune District Women and Child Development Department.
The complaint was lodged by Prashant Shirke,acting District Women and Child Development officer,after he found that Yanmal had kept children under 16 years of age in bad condition at the unauthorised ashram.
The court also granted permission to arrest Yanmal under Section 13 of Orphanages and Other Charitable Homes (supervision and control) Act,1960 for running the Gurukul Godavari Balakashram without the permission of Charity Commissioner.
Earlier,the police had arrested Yanmal for allegedly selling an HIV infected baby illegally to a Mumbai couple in April last year. The baby died of AIDS in December following which Anita Yadav of Goregaon,Mumbai,who had adopted him from Yanmal lodged the police complaint. The police had also arrested Shivaji Sanake of Preet Mandir who had given Yanmals contact number to Anita.
On Tuesday,police sub inspector Dattatraya Raut produced Yanmal and Sanake before the court.
Public prosecutor Kiran Bendbhar sought the courts permission to arrest Yanmal in two other cases. The court granted the permission and remanded the two to magisterial custody.
Raut,who is the investigation officer,said any person who has the custody of a child under 16 years and carelessly handles the child is entitled to six months imprisonment under Section 23. Similarly,a person who physically or mentally harasses a child is entitled to up to three years of rigorous imprisonment as per Sections 26 and 28, he said.
The police are investigating how Yanmal procured the fake birth certificate of the HIV affected baby from Phursungi gram panchayat.
