Following DNA test reports,the Pune district and sessions court on Friday sentenced autorickshaw driver Vinod Dattatraya Nirgurkar (35) to 10 years rigorous imprisonment for raping a 16-year-old girl. The incident took place at Shevalwadi in Manjari on June 24,2010. The complaint was registered by the victims mother at the Loni Kalbhor police station.
Interestingly,the complainant had herself turned hostile during the court trial claiming that she did not lodge police complaint. However,the DNA test report confirmed that Nirgurkar had raped the girl. The DNA report proved to be a major evidence which led to conviction.
As per the prosecution ,the complainant had separated from her husband when the victim was five years old. Following this she came in contact with Nirgurkar,a resident of Shevalwadi,and started satying with him and sent her daughter to Mahila Seva Gram hostel in the city.
After staying at the hostel for about nine years,the girl returned and started living with her mother and brother. Nirgurkar used to give Rs 200 per day to victims mother for livelihood.
On June 24,2010,he forcibly raped the girl while she was alone at home and threatened he of dire consequences if she told anyone about the incident.
The girl,however,narrated the incident to her mother who initially ignored it. But later,when the girl became pregnant,her mother lodged a police complaint. The girl was subjected to abortion at the Sassoon General Hospital.
However,during the court trail,her mother told the court that she did not lodge a police complaint.
Additional public prosecutor Ramesh Ghorpade said that complainant is financially dependent on the accused and hence she may be lying.
Defence lawyers argued that incident took place with the consent of the girl. Meanwhile,the DNA test of girl proved the rape. District and sessions judge S P Tawade charged the accused of rape and sentenced him to 10 years rigorous imprisonment. The prosecution examined 12 witnesses in the case.
