Provogue case: Two cops granted bail

The Bombay High Court on Monday granted bail to two policemen who had allegedly framed Salil Chaturvedi,the deputy managing director of Provogue,in a narcotics case.

The Bombay High Court on Monday granted bail to two policemen who had allegedly framed Salil Chaturvedi,the deputy managing director of Provogue,in a narcotics case. The two policemen,Subhash Kinjale and Madhukar Gatade,had approached the High Court after a sessions court on August 14 rejected their bail applications.

Kinjale and Gatade were arrested after Chaturvedi filed a complaint following his acquittal by a special Narcotic Drugs and Psychotropic Substances (NDPS) court in 2009. In their application,the two policemen contended that they were falsely implicated in the case.

While granting them bail,Justice Abhay Thipsay upheld their argument that except Section 195 of the Indian Penal Code (IPC),which deals with giving false evidence,the other sections against them are bailable.

Soon after his acquittal,Chaturvedi had moved the Bombay High Court,which had ordered a probe by the Criminal Investigation Department (CID). Before appraoching the HC,Chaturvedi had filed a private complaint against three police officers including Kinjale and Gatede alleging that they had planted cocaine in his house in Lokhandwala,Andheri a day after his arrest on August 3,2005. The third officer is IPS officer Parambir Singh.

During the trial before the NDPS court,Kenjale is said to have admitted that Chaturvedi,in a statement before him on June 30,2005 said he apprehended some senior police officers would falsely implicate him.
