Duncan Grant and Allan Waters,the two British nationals whose acquittal in a sexual abuse case was overturned by the Supreme Court on Friday,surrendered before a sessions court on Monday. On Friday,the Supreme Court had ordered the two to be sent to jail to complete their sentences. The duo have been charged with sodomy and sexually abusing five minors in the Anchorage shelter home,Colaba.
The duo,who claimed they were arrested and not allowed to surrender before the police,told the court that they,as per directions of their counsel,were on their way to the court,from where they would have been arrested and taken to jail. But the police stopped them and arrested them. The police didnt allow us to surrender. Surrendering would give us scope of remission, Grant told the court.
Hearing them,the court said at this stage only their custody could be ordered by the court and they could make the submission at the right time before the right forum. I have taken your greivances on record. You can approach the right forum, the court said.
The two had appealed against a March 2006 conviction by a sessions court sentencing them to six years in prison on charges of sodomy and assault. They were later acquitted by the HC in 2008. On Friday,while holding for British Navy man Duncan Grant,former Lieutenant commander Allan Waters and their Indian associate William Dsouza guilty of sexually abusing children at the Anchorage Shelter Home and indulging in unnatural offences,the Supreme Court based its findings on the same four witnesses whom the High Court had termed as unreliable. While Grant has spent three years and two months behind bars,Waters,who was arrested in the US and brought to India in 2004,has spent five years in jail.
Both accused were presented before Sessions Judge D Shirsao,who read out the apex courts judgment to them and asked them if they were aware of the order. Both accused appeared nonchalant through the hearing. Grant and Waters,who were brought into the court a few minutes before the hearing,also had an unprovoked altercation with journalists. Later,when the issue was brought to the courts attention,the duo apologised to the reporters.
