(Express Photo) In the wake of a petition filed by Shiv Sena (UBT) MLA Sunil Prabhu in the Supreme Court seeking direction to the Maharashtra Assembly Speaker to expeditiously decide on the disqualification plea against rebel Sena MLAs led by Eknath Shinde, Rahul Narvekar on Monday said the court cannot dictate him a timeframe to decide on the matter.
“The court cannot dictate the Legislative Assembly Speaker a timeframe to decide on the matter. Even if it does, I have a right to not accept the notice to this effect. Yes, the court can decide once I take the decision, but the court cannot order the Speaker and force him to take a decision,” said Narvekar, speaking to reporters here.
Narvekar said that notices have been served to MLAs of both Sena camps and if he gets a petition seeking additional time to reply, then he will decide on it based on the content of the request.
While the Speaker is yet to deal with the dispute in the Sena, he is also facing the issue of rebellion within the NCP. Party leader Ajit Pawar along with eight other leaders took oath as ministers in the present state government on July 2.
Opposing the move, the group supporting NCP president Sharad Pawar led by Jayant Patil has filed a petition with Narvekar seeking suspension of the nine NCP MLAs, including Ajit Pawar.
Narverkar said Patil has also filed an interim petition for “temporary suspension” of these nine NCP ministers. The petition claims that the group has gone against the party line. “Patil’s petition requests the Speaker to temporarily suspend Ajit Pawar’s faction for going against party lines,” he said.
However, sources in the Speaker’s office said that such a petition is not tenable. “No decision has been taken on the first petition filed by Patil. There is no such provision called temporary suspension; hence the Speaker cannot maintain such a petition,” an official said.
New Assembly building proposal
Narvekar on Monday said that he is set to move a proposal for building a new Assembly building on the lines of Central Vista in New Delhi. “The present building does not have the capacity to house MLAs post-realignment of Assembly seats. We have a plan to build a new Assembly campus, which will cover the present parking lot. A proposal to this effect will be moved to the department concerned soon,” he said.
