Jaitapur protest: HC refuses to pass order

While hearing a petition filed by the Indian People’s Tribunal and retired Supreme Court Justice PB Samant seeking a public hearing pertaining to the Jaitapur nuclear power project,Chief Justice Mohit Shah on Thursday remarked,“It is not judging your intentions,it is judging the consequences of your action.” Arguing for Samant, lawyer Sunip Sen told the court that the prohibitory order issued to him by the state was illegal as no prior hearing was given to him. “I have a right to tell them (villagers) that nuclear power is dangerous. I may be right or wrong,” Sen told the court. However, the government counsel told the court that a law and order problem cannot be foreseen. “If the situation demands,we have to take this recourse,” he said.
