60-yr jail term: state submits guidelines

The state government on Monday submitted the draft guidelines on 60-year imprisonment for TADA convicts,to the High Court.

The state government on Monday submitted the draft guidelines on 60-year imprisonment for TADA convicts,to the High Court.

The court had last week directed the state to clarify under which category of the 1992 guidelines does its order seeking 60 years’ imprisonment for TADA convicts fall. The state also informed that it would soon make the same rule applicable for MCOCA and POTA convicts as well.

The court has adjourned the hearing till Monday for arguments. The court was hearing petitions filed by 1993 serial blasts convicts. As per the state’s latest guidelines,blast convicts will have to undergo 60 years imprisonment or face imprisonment till they are 65. Advocate for the convicts,N N Gavankar,argued that the guidelines were made after the conviction and cannot have retrospective effect.

“We informed the court that we would soon make the rule applicable to MCOCA and POTA convicts also,” said Acting Public Prosecutor P A Pol.
