‘SHO acted on seniors’ instructions’

The CBI team,probing into the Banda rape case involving BSP MLA Purshottam Naresh Dwivedi,on Saturday interrogated the then SHO of the Atarra police station Abdul Jabbar.

The CBI team,probing into the Banda rape case involving BSP MLA Purshottam Naresh Dwivedi,today interrogated the then SHO of the Atarra police station Abdul Jabbar.

CBI sources said that Jabbar,who was suspended along with other officials by the state government later,reportedly has held the senior police officers responsible for lodging a theft case against the victim girl and sending her to jail. He also claimed that it was the senior officers who had ordered him not to lodge the FIR — on the girl’s complaints — alleging rape against the MLA and his men.

When inquired about the interim report of the CB-CID in which he was held responsible for harassing the girl and her family members,besides the then Banda Superintendent of Police Anil Kumar Das,Jabbar replied that since he was the SHO of the concerned police station,whatever action initiated in the matter he was held guilty.

Sources also said that the cop has referred names of the senior police officers who reportedly had ordered him to frame the girl in the fake case of theft of Rs 5,000 and a mobile phone from the MLA’s house.

The CBI refused to divulge names of the officers,but confirmed that they have been sending notices to the said senior cops for interrogation.

The then Circle Officer of the area Rajendra Chaudhary,Additional SP Lala Ram and Jailor of Banda district jail Gyan Prakash,besides SHO Abdul Jabbar,were among the suspended officials. The SP,however,was transferred after five months.

Meanwhile,the former SHO also told the CBI that the MLA’s son Mayank Dwivedi had sent the complaint to the police station on December 13,2010 alleging that the girl had escaped after the theft from his house at 3 am the same day. The girl was caught the next day about 15 kilometres away from the MLA’s house and was produced before the court,from where she was sent to jail.

The SHO,however,denied the girl’s statement regarding her arrest. The victim had told the agency that the SHO had caught her from the same area on December 13 and brought her to the police station. Also that,she was tortured by the police,the MLA and his associates in presence of the SHO.

Asked about the reason behind not registering the rape case and giving clean chit to the MLA,Jabbar said that he was given clear instructions from the superiors not to entertain the girl’s complaint.

The Investigating Officer (IO) in the theft case,Radhe Shyam Shukla too was ordered to fabricate such a sequence of events in the case diary that the allegation of rape cannot be corroborated,CBI sources said.

The girl had alleged that she stayed at MLA’s house between December 8 and 12 last year where she was raped by the MLA and his associates. A woman member of the MLA’s family had helped her to escape from his house.

The MLA and four of his associates – Rajendra Shukla,Surendra,Ravan and Garg – had been named in the case under IPC sections of 376 (rape),354 (assault or criminal force to woman with intent to outrage her modesty),323 (voluntarily causing hurt),504 (intentional insult with intent to provoke breach of peace) and 506 (criminal intimidation).
