Police Thursday arrested former BSP leader and Pradeshik Cooperative Federation (PCF) Vice-Chairman Shiv Kumar Gupta from Aliganj area in connection with a case of cheating and forgery.
The case against Gupta was lodged by a city-based builder Uttam Agarwal at Madiaon police station in 2010. Later, the police investigation was transferred to Special Investigations Cell and then to Gudamba police station.
The case had been lodged under various sections of the IPC,including 420 (cheating),468 (forgery),471 (using a forged document as genuine),and 201 (causing disappearance of evidence of offence),against Gupta and five of his associates.
According to the complaint lodged with the police,Gupta and Agarwal had formed a partnership firm named Apoorva Constructions,in 2001. According to the agreement, both constructed shops on a plot in Madiaon area. The land was provided by Gupta while the construction of 84 shops was done with Agarwals money.
However, once the construction was completed,Gupta allegedly stole all the documents related to the partnership deed, according to which the both were owners of 42 shops each. Later,Gupta sold the shops with the help of a forged partnership deed, police said.
Agarwal alleged he was framed into several false cases by Gupta, but,in 2010,he procured the fake partnership deed used by Gupta and lodged an FIR on its basis.
Gudamba station officer Ramnaresh Yadav, who is probing the case, said Gupta had allegedly duped Agarwal of crores of rupees by selling the shops built in partnership without giving any money to Agarwal.
Gupta was made the PCF Vice-Chairman during the previous BSP government and enjoyed the status of Minister of State. Later,he was sacked from the BSP and joined the Janwadi Party.
