Nimesh panel questions timing,manner of HuJI ‘activists’ arrest

More than one year after the Nimesh Commission submitted its inquiry report on the arrest of alleged HuJI activists for their alleged involvement in serial blasts at district courts of Lucknow,Varanasi and Faizabad,the Uttar Pradesh government on Monday tabled the report in both Houses of the Assembly.

In its 233-page report,Commission head Justice (retd) R D Nimesh has raised suspicion over the timing and manner in which the alleged HuJI activists — Khalid Mujahid and Tariq Qasmi — were arrested from Barabanki on December 22,2007.

In the report,the Commission has also raised suspicion over the recovery of objectionable items from the possession of the two. The UP Police had claimed that while nine gelatin rods,three detonators,a Nokia cellphone with SIM card were recovered from Khalid,three detonators,RDX,a Nokia cellphone with a SIM card was found on Tariq.

The Commission had submitted the report (see box) to Chief Minister Akhilesh Yadav on August 31,2012. The state cabinet,on June 4,had accepted that report and announced that it would be tabled in the Assembly.

Demands for making the inquiry report public was raised from different quarters after Khalid died mysteriously on May 18. He died while returning to the Lucknow District Jail after attending a hearing in the case in Faizabad.

In the report,the Commission has stated: “Arresting of Mohd Khalid Mujahid and his associate Tariq Qasmi from Barabanki railway station on December 22,2007 and recovery of objectionable items from their possession appear suspicious.” It also observed that statements of certain witnesses of prosecution could not be trusted.

The panel has concluded that some people had picked up Tariq from Shankarpur checkpost in Rani Ki Sarai police area on December 12,2007.

“Similarly,it is clear from the evidence and statements of witnesses that Khalid was picked up by some people from Mahatwana Mohalla in Madiyahun police area in Jaunpur on December 16,2007,” the report stated.
