The additional sessions court in Chandauli on Tuesday acquitted MLA Mukhtar Ansari,the BSP candidate for Varanasi Lok Sabha seat,and his associate Bheem Singh in a case of murder of a constable,Raghubansh Rai,which took place in 1991.

They were acquitted for lack of evidence as all the six witnesses refused to have seen the assailants who escaped after firing.

“Of the six witnesses,five were policemen but none of them said that they had seen the men who fired at them. They claimed they were at a distance of 100 metres and it was a dark night,” said prosecuting officer Manju Pandey. She added that no one knows the details of the vehicle that was used in the crime.

The inspector who led the police party that was attacked had since died and the investigating officer did not mention anything about the vehicle in the case diary.

According to the prosecution,around 8 pm on December 30,1991,a team police led by Mughalsarai police station in-charge Nanke Singh Gangwar were trailing a suspicious Maruti gypsy when it met with an accident. The occupants allegedly came out and fired at the police team,killing Rai and injuring another constable.

During the investigation,it was allegedly found that Mukhtar Ansari and his associates were inside the gypsy. Ansari was among the 10 charge-sheeted in the case.

With today’s judgement,five of the 10 accused have been acquitted. One has died,one is absconding,and the trial of three is pending.
