HC suspends district judge

The Allahabad High Court has suspended Ambedkar Nagar District Judge Dileep Singh Yadav and Additional Sessions Judge Indra Bhushan Goel — posted in Kushi Nagar — for passing a judgment in defiance of an order of the administrative judge.

The administrative judge had ordered Yadav to hear a murder case,but he had transferred the case to the additional sessions court. The court in turn acquitted one of the accused — a historysheeter and brother of Rakesh Pandey — the BSP candidate from Ambedkar Nagar.

The High Court has now attached the judges with the Azamgarh district court.

In July 2004,Anand Kumar,a businessman,was shot dead in Ambedkar Nagar. His family lodged an FIR against eight persons,including then Samajwadi Party MLA Rakesh Pandey’s brothers Pawan Pandey and Krishna Kumar Pandey alias Kakku Pandey.

The police arrested Kakku and filed chargesheet against him and four others. A few months later,the state government transferred the investigation to CB-CID,which filed a chargesheet against Pawan and two unidentified persons.

District Government Counsel Rakesh Singh,elder brother of the deceased,said: “Despite the High Court orders,the district judge transferred the trial to the Additional Sessions Court. It acquitted Pawan Pandey in September 5,2008. After the order,I had moved the Supreme Court,the Chief Justice,Allahabad High Court and Administrative Judge.” ens
