HC glare on Ghaziabad plot allotment

The Allahabad High Court today asked the Ghaziabad Development Authority to explain its policy for allotting plots to ministers,MPs and MLAs,besides other highly-placed personalities,under a scheme that has not yet apparently been brought on record.

The court said that prima facie such a policy seemed “arbitrary and unreasonable”.

The court also sought an explanation on how a plot was awarded to the then state minister,Satish Sharma,in Indirapuram area of Ghaziabad within a day in 2001.

Further,the court has questioned whether there exists any policy of allotment of plots or flats to the blood relations of GDA employees. The court has listed the matter for further hearing on July 3.

Hearing a petition filed by one Sharda Prasad,whose services have been terminated by the GDA,a single judge bench of Justice Sabhajeet Yadav said: “In case there exists any policy of GDA in respect of allotment of flats,plots and buildings to the MLAs,MPs or any other high personality under any scheme,the same is not available on record. But such policy appears to be prima facie arbitrary,unreasonable and against public policy. Therefore,the vice-chairman,GDA is directed to bring on record the aforesaid policy of GDA.”

The court also took note of the fact that Sharma had got a plot in Shakti Khand (S.K.-II/01) allotted by the GDA on his letter written on August 8,2001. The allotment of this plot,measuring 395.17 square metres at the rate of Rs 2,500 per square metre,was made on the same day by the vice-chairman of the GDA. The court said that it was apparent that this was done without following due procedure. The court has asked the vice-chairman,GDA,to bring on record the correspondence between the GDA and the said minister,along with his wife,that led to the allotment of the plot.

Further,the court said that there seemed to exist a policy of GDA,wherein blood relations of officers and employees of the authority were allotted flats or plots. It also appeared that those getting these plots and flats were entitled to transfer it to their other family members,the court noted. It said that if such a policy existed then it should be brought on record. The vice-chairman,GDA,has been directed to file a personal affidavit in this regard and inform the court as to how many employees and officials have benefited under such policy. The court reiterated that such a policy promoted “nepotism and favouritism”.
