The petitioner’s counsel submitted that the girl is deaf and mute. We allow the victim to undergo medical termination of her pregnancy at the earliest.” The Lucknow bench of the Allahabad HC Wednesday directed that a 12-year-old rape victim could undergo medical termination of her 25-week pregnancy after taking into account a report of a Medical Board in which doctors said “continuation of pregnancy poses a greater risk to her physical and mental health due to her tender age.”
“Considering the facts and the medical report, it would be appropriate to order termination of pregnancy of the petitioner after considering the medical evidence,” a division bench of Justices Mahesh Chandra Tripathi and Prashant Kumar said in its order.
The court directed the District Magistrate, Bulandshahar, to ensure that the girl, along with her mother, reports to a medical college in Aligarh on July 13. The court also directed the principal of the medical college to ensure the termination of the girl’s pregnancy, adding that the procedure is to be carried out in the presence of the head of the department of obstetrics and gynaecology.
