The Allahabad High Court has transferred the trial of the PWD engineer Manoj Gupta murder case from Auraiya district court to Lucknow sessions court. The court also ordered that the trial be completed within six months.
Justice Saroj Bala passed the order on Monday on a petition filed by Vibha Tiwari,the wife of BSP MLA Shekhar Tiwari and a co-accused in the case. Incidentally,Shashi Gupta,the wife of Manoj Gupta too had moved an application to transfer the case, alleging that Shekhar Tiwari would influence the trail in Auraiya and Kanpur. The accused wanted the trial to be transferred to nearby districts like Kanpur but I pleaded with the court to transfer the case to Lucknow so that an impartial trail could be carried out, said IB Singh, special counsel to the state government.
Justice Bala observed that the session judge Auraiya and many judicial officers lived in the same colony where the deceased engineer used to reside and where the incident took place. To ensure an impartial trial,it would be proper to transfer the case,the judge said. Gupta was murdered on December 24,2008 and an FIR was lodged at Dibiyapur police station in Auraiya district against Shekhar Tiwari.
