CBI ‘rejects’ probe into Khalid’s death

The CBI is understood to have turned down the UP government’s recommendation for investigation into alleged HuJI operative Khalid Mujahid’s death while he was being taken to Faizabad from Lucknow district jail on May 18.

The CBI is understood to have turned down the UP government’s recommendation for investigation into alleged HuJI operative Khalid Mujahid’s death while he was being taken to Faizabad from Lucknow district jail on May 18.

While the UP government had dispatched a letter to DoPT on May 19,requesting for a CBI investigation into the case,the Department of Personnel and Training (DoPT) has yet not issued a notification for the investigation.

A notification from DoPT,under section 5 of the Delhi Special Police Establishment (DSPE) Act,is required before the CBI accepts a case,sources said.

CBI chief information officer Dharini Mishra confirmed on Friday that the CBI had not received any notification in the case.

The state government had also attached a letter of notification,under section 6 of the DSPE Act,giving its consent for investigation.

Sources said the CBI headquarters had sought details,including the autopsy report,related to Khalid’s death . The DoPT has already scrutinised the details of the case and did not find it fit to hand it over for investigation to the CBI,the sources added.

A judicial inquiry into Khalid’s death on May 19,which is being conducted by chief judicial magistrate of Faizabad,is yet to be concluded while another inquiry by a committee comprising UP’s Secretary (Home) and ADG (Power Corporation) is also under way since May 18.

Lucknow chief medical officer (CMO) has set up another committee to inquire into the allegation of the Lucknow jail superintendent who wrote him a letter on June 7 about negligence by jail doctors in attending to Khalid’s complaint of chest pain before he left for Faizabad on May 18.

Meanwhile,investigation is yet to begin in the case of murder registered regarding Khalid’s death at Barabanki city Kotwali police station on May 19. The accused in the case include former UP DGP Vikram Singh,ex-ADG (Law & Order) Brij Lal and some STF,ATS and IB officials.

Khalid Mujahid was one of the accused in the blast on Faizabad court premises on November 23,2007. He was also facing charges of carrying explosives and detonators at the time of his arrest in Barabanki after on December 22.

The prosecutor had moved an application in the court for withdrawal of the case against Khalid and another alleged HuJI man,Tariq Qasmi,in the Barabanki case on May 3,The petition was,however,rejected on May 10.
