A youth who had repeatedly raped a 20-year-old girl here on the false promise of marrying her has been sentenced to jail for 10 years by a Delhi court,which relied on the DNA report of the victims child.
The court also relied on the testimony of the woman and other evidence produced before it while convicting 22-year-old Lalit Chauhan and imposed a fine of Rs 45,000 on him.
It said that the prosecution has established that Chauhan had repeatedly raped the woman from December 2011 to March 2012 on the promise of marrying her,but after she became pregnant,he refused to tie the knot with her.
Admittedly,the fact regarding of having repeated sexual intercourse with the prosecutrix has not been disputed by the accused (Chauhan) nor the fact regarding the pregnancy of the prosecutrix consequent upon the act of having repeated sexual intercourse with the prosecutrix has been disputed by the accused.
Nor the fact regarding the baby girl born to prosecutrix on September 4,2012 was fathered by accused Lalit Chauhan has been disputed by the accused, Additional Sessions Judge M C Gupta said,adding the woman had delivered a baby whose DNA profiling matched with Lalit Chauhan as a biological father.
The court convicted Chauhan,a resident of Vishvas Nagar,for the offences punishable under the IPC,including Section 376 (rape),and under provisions of the Information Technology Act.
According to police,the woman had lodged a complaint on March 5,2012,stating that she met Chauhan in 2010 and they became friends.
On December 25,2011,they went to Purana Qila in the city where Chauhan mixed something in her cold drink,after which she fell unconscious,the police said.
Police said Chauhan took her nude photographs and raped her.
Police said Chauhan raped the woman for over two months after threatening that he would put her nude photographs on the Internet. According to police,Chauhan also promised the woman that he would marry her. But after she became pregnant,Chauhan refused to marry her.
During the trial,Chauhan claimed that he had been falsely implicated in the case and his lawyer argued that the woman was a consenting party in the physical relations as she was in love with his client.
The court,however,convicted him saying ….prosecution has been able to bring the guilt home to accused Lalit Chauhan beyond shadows of all reasonable doubts and there is no room for hypothesis,consistent with that of innocence of accused.
