Three special courts in Delhi to deal with POCSO cases against former parliamentarians

Three special courts in Delhi’s Rouse Avenue District Court Complex have been designated to deal with cases lodged under the Commissions for Protection of Child Rights (CPCR) Act, 2005, and the Protection of Children from Sexual Offences (POCSO) Act, 2012, against former parliamentarians.

Earlier in July 2023, Delhi’s Lieutenant Governor (LG) V K Saxena had approved the setting up of three special courts to deal with such cases against sitting MPs and MLAs. This ambit has now been expanded to deal with cases against former MPs and MLAs as well.

The notification came after directions by the Delhi High Court on setting up of new courts, in December 2020. “However, the previous Kejriwal Government had inordinately delayed their notification for more than 03 years,” according to a Delhi government statement.

The three now-designated courts are the courts of Special Judges Jitendra Singh, Dig Vinay Singh and Vishal Gogne.

“The proposal to this effect, seeking LG’s approval for the creation of these designated/Special Courts under Section 25 of the CPCR Act and Section 28 of the POCSO Act was moved by the WCD Department and vetted by the Law Department,” the statement by the Delhi government also said.

These three courts are in addition to the eight courts, which are already trying cases related to offences against children, violation of child rights and POCSO Act cases.

The POCSO Act provides that state governments shall, in consultation with the Chief Justices of the High Courts of the respective states, designate courts to try such offences.

Similarly, the CPCR Act states that “the state government may, with the concurrence of the Chief Justice of the High Court, by notification, specify at least a court in the state or specify, for each district, a Court of Session to be a Children’s Court to try the said offences”.
